SB100 and SB89
("Homeowners Bill of Rights")

Colorado Governor Owens signed Senate Bill 05-100 (also known as the "Homeowners' Bill of Rights") into law on June 6, 2005. The new law, now in full effect, affects many aspects of the governance and operation of associations in Colorado. Associations are required to be in compliance with the law's new requirements, which include governance policies and procedures.

On May 26, 2006, Governor Owens signed Senate Bill 06-089 (entitled “HOA Cleanup Legislation") into law. This bill contains amendments to SB 05-100, addressing such issues as the requirement to use a secret ballot, the required use of generally accepted accounting principles (“GAAP”), and conflicts of interest.
